Terms and Conditions

Article 1: Scope of application – general provisions

These General Terms and Conditions of Sale apply to all orders for products placed on the website www.tatamiportable.com, an authorised sales agent for the sole trader Il Fiore d’Oriente di Bernardo Corvi, whose registered office is located at Borgo dei Segantini, 8 – 43037 Lesignano de’ Bagni (PR) – Italy.

In these General Terms and Conditions of Sale, the following terms shall have the following meanings:

  • the term ‘the Customer’ refers to any person visiting or making a purchase via the website www.tatamiportable.com;
  • the term “the Company” refers to the company Il Fiore d’Oriente;
  • the term “the Products” refers to the products offered on the website www.tatamiportable.com and supplied by Il Fiore d’Oriente to the Customer;
  • the term “the Website” refers to the website www.tatamiportable.com

The online sale of the Products presented on the Website is reserved for end-user Customers, to the exclusion of traders, wholesalers and resellers who wish to resell these same products to third parties.

All purchases are governed by the provisions of Legislative Decree No. 185/99 (implementing Directive 97/7/EC on the protection of consumers in respect of distance selling) and those of Decree No. 196 of 30 June 2003 (Consolidated Law on the Protection of Personal Data).

Article 2: Acceptance of the General Terms and Conditions of Sale

The Customer confirms that they have read and accepted the General Terms and Conditions of Sale by ticking the box marked ‘I accept the General Terms and Conditions of Sale’ before proceeding with the online ordering process.

These General Terms and Conditions of Sale shall prevail over any other terms and conditions contained in any other document, unless expressly agreed otherwise in writing in advance.

The General Terms and Conditions of Sale are available at all times on the Website.

Article 3: Order – Price – Availability

Orders are placed by the Customer at the price indicated on the Website at the time the Customer confirms their order.

The prices of the Products displayed on the Website are quoted in euros, inclusive of all taxes, and include postage and insurance for deliveries within Europe.
An additional charge may be applied for deliveries outside Europe (including French overseas departments and territories).

Any specific local taxes (customs duties, dock dues, etc.) remain the responsibility of the Customer.

The Products offered on the Website are handmade to order.
Before confirming their order, the Customer will see a summary of the order showing the description and unit price of each pre-selected Product, as well as the total cost in the case of an order comprising several Products.

Once the order has been placed, and prior to payment, the Customer will receive an email confirming that the order has been registered, which will include a summary of the order and its reference number. Once payment has been accepted, the Customer will receive an order confirmation email confirming that the order preparation process has begun.

The Company reserves the right to cancel an order in the event of fraudulent use of payment methods and/or fraud at the Company’s expense.

Article 4: Payment

Payment for orders is made online by payment card (debit card, credit card).

Payments made on the Website are fully secure.
The payment card details provided when placing an order are never transmitted in plain text over the network: they are encrypted using the SSL (Secure Socket Layer) protocol.
The security of data transmission is thus guaranteed in accordance with current banking procedures.

PLEASE NOTE: the Customer’s account will be debited at the time the order is confirmed.

Article 5: Delivery

Products are delivered to the delivery address provided by the Customer during the ordering process.

All delivery times quoted are calculated in working days (Monday to Friday, excluding Saturdays, Sundays and public holidays) and are subject to the order being confirmed.

Except in special circumstances (out of stock or force majeure), deliveries are made within a maximum of 15 working days in Europe, from the date the order is confirmed. For all shipments outside Europe (including French overseas departments and territories), the maximum delivery time is 25 working days.

Deliveries may be split into separate shipments, for which the Company shall not be held liable.

To ensure perfect packaging, parcels are wrapped in transparent film and sealed with adhesive tape.

The Customer is required to check that the goods delivered are in order at the time of delivery and before signing the delivery note provided by the delivery service.

The Customer must note any discrepancies regarding the delivery on the delivery note in the form of handwritten reservations accompanied by their signature.

This check is deemed to have been carried out once the Customer, or a person authorised by them, has signed the delivery note.

If, upon delivery, the original packaging is damaged, torn or opened, the Customer must check the condition of the Products. If they have been damaged, the Customer must refuse the parcel and note this on the delivery note (parcel refused because it was opened or damaged).

Article 6: Complaints and warranties

Products ordered on the Website are covered by a warranty of conformity in accordance with Legislative Decree No. 24 of 2 February 2002 (on sales contracts and warranties for consumer goods) and with the provisions of the Italian Civil Code.

These guarantees apply to Products that present defects of conformity and/or malfunctions not detectable at the time of receipt of the delivery, provided that such Products are properly maintained and used in accordance with the instructions in the user manual.

Exclusions from the warranty

Any warranty is excluded in the event of misuse, negligence or lack of maintenance on the part of the Customer, as well as in the event of normal wear and tear of the goods, accident or force majeure. The Company’s warranty is limited to the replacement or refund of non-compliant or defective Products.

No warranty applies to apparent defects which the Customer had the opportunity to detect upon delivery in accordance with Article 5.

In the event that a Product is indeed covered by this warranty, the Customer may make a claim by contacting the Company within 10 working days of the delivery date.

Only the Company is authorised to determine whether the fault is covered by the warranty; it may replace non-compliant Products and reserves the right to verify the defect reported by the Customer and to carry out the replacement only after such verification.

Before returning any defective Products to the Company, the Customer must send an email to info@fioreoriente.com specifying the nature of the goods to be returned and providing a description of the fault observed. They will then receive a reply by email containing the information required to claim under the warranty. If this procedure for handling warranty claims is not followed, repair/replacement times may be significantly extended.

The Customer shall return the Product(s) in suitable packaging and enclose:

  • a letter specifying: the order number and date, and a description of the defect found;
  • a copy of the invoice or proof of purchase.

The return costs and the delivery charges (postage and insurance) for the new delivery (new Products or repaired Products) are to be borne by the Customer.

Article 7: Right of withdrawal

In accordance with Italian law, as set out in the regulations governing distance selling, the Customer has the right of withdrawal.

The Company accepts the return of Products without reservation, provided they are intact, clean and properly packed in their original packaging. The Customer is responsible for the return postage costs.

The Customer has a period of 10 working days from the confirmation of the order (Article 3) to exercise their right of withdrawal and return the Products. The Company undertakes to refund the full amount of the Products ordered (excluding delivery charges).

The Customer must enclose a copy of the delivery note in the return parcel. They must send the parcel to the following address: Il Fiore d’Oriente – Borgo dei Segantini, 8 – 43037 Lesignano de’ Bagni (PR) – Italy.

Article 8: Protection of personal data

All personal information that the Customer is required to provide in order to use the Website’s services is used for the purpose of fulfilling the obligations arising from the sales contract between the Customer and the Company and is subject to the relevant EU provisions and regulations in force.
In accordance with Article 7 of Legislative Decree No. 196 of 30 June 2003, the Customer has the right to access, amend, rectify and delete data concerning them. To exercise this right, the Customer must write to the Company’s registered office.

Article 9: Incidents and force majeure

The Company shall not be held liable in the event that the non-performance of its obligations is attributable either to an unforeseeable and insurmountable act by a third party not party to the contract, or to a case of force majeure (non-exhaustive list):

  • state of emergency;
  • natural disaster (earthquake, storm, flooding, mudslide, fire, etc.);
  • adverse weather conditions;
  • strike;
  • revolution, war, terrorist attacks;
  • epidemic;
  • malfunction or interruption of national or international transport links, or of national or international postal services.

Article 10: Governing law and competent courts

These General Terms and Conditions of Sale are governed by Italian law.

In the event of a dispute, jurisdiction shall be determined in accordance with Regulation (EC) No 44/2001.
